General Terms and Conditions

§1 Scope and Provider

  1. These General Terms and Conditions apply to all contracts concluded via the online shop https://vita-bayern.com/ between you and us,

  2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (Section 13 German Civil Code – BGB).
    An entrepreneur is any natural or legal person acting in the exercise of their commercial or independent professional activity (Section 14 BGB).

  3. Deviating or supplementary terms and conditions of the customer shall not become part of the contract unless we expressly agree to their validity in writing.


§2 Conclusion of Contract

  1. The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

  2. By submitting an order via the online checkout, you make a binding offer to conclude a purchase contract.

  3. The contract is concluded when we accept your order by sending a separate order confirmation (e.g. shipping confirmation) by email or by delivering the goods.

  4. Please check your details carefully before submitting the order and ensure that the email address provided is correct, as all contractual communication is carried out by email.


§3 Prices and Payment Terms

  1. All prices stated in the online shop include statutory value-added tax (VAT) and exclude shipping costs unless expressly stated otherwise.

  2. Payment can be made using the payment methods offered during the checkout process (e.g. PayPal, Klarna, SOFORT, credit card, etc.). The terms and any fees of the respective payment service provider apply.

  3. Unless otherwise stated, the purchase price is due immediately upon conclusion of the contract.


§4 Delivery and Shipping

  1. Delivery is made to the delivery address specified by the customer.

  2. Information on delivery times can be found on the relevant product or shipping information pages in the online shop.

  3. For consumers, the risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods.


§5 Retention of Title

The goods remain our property until full payment of the purchase price has been received.


§6 Right of Withdrawal

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

Withdrawal Period

The withdrawal period is 14 days from the day on which you or a third party designated by you (who is not the carrier) takes possession of the goods.

Exercise of the Right of Withdrawal

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g. by email or letter) of your decision to withdraw from this contract.


Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notice of your withdrawal.

We will use the same means of payment for the reimbursement that you used for the original transaction, unless expressly agreed otherwise.

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of the withdrawal.
You bear the direct cost of returning the goods.


§7 Warranty / Liability for Defects

  1. Statutory warranty rights apply.

  2. Consumers are requested to inspect the goods immediately upon delivery for completeness and visible defects and to notify us promptly of any complaints. This does not affect statutory warranty rights.


§8 Liability

  1. We are liable for damages caused by slight negligence only in the event of a breach of essential contractual obligations (cardinal obligations). Essential contractual obligations are those whose fulfilment is necessary for the proper performance of the contract.

  2. Liability under the Product Liability Act remains unaffected.


§9 Governing Law and Jurisdiction

  1. The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence.

  3. If legally permissible, the place of jurisdiction shall be the registered office of the company.


§10 Final Provisions

  1. Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

  2. Amendments to these Terms and Conditions will be communicated to the customer prior to the conclusion of the contract.
